16. Dispute Resolution
Any dispute or difference arising out of or relating to these Terms shall first be attempted to be resolved amicably through mutual discussion. If unresolved within [30] days, the dispute shall be referred to arbitration by a sole arbitrator appointed by Siddham Infra, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Indore, Madhya Pradesh, and the language shall be English. The arbitral award shall be final and binding.
Nothing in this clause affects the rights and remedies available to allottees under the Real Estate (Regulation and Development) Act, 2016.
17. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect. The right or provision shall not constitute a waiver of that right or provision.
